Change of ownership
We explain how to carry out the change of ownership of a second-hand boat in a few steps. At Astur-Náutica, we can handle this procedure for you so that you can be relieved of this administrative task.
The process of changing ownership of boats or transferring ownership must be carried out each time a boat is bought and sold and once the purchase contract has been finalized and the boat has passed into the hands of the buyer and therefore the new owner.
The transfer must be communicated to the competent authority, in order to process the change of ownership, within a maximum period of three months (Article 54 of RD 1027/89).
It is highly recommended before purchasing a second-hand boat to request a copy of the Vessel Registration Certificate. This document contains all the administrative processes during the life of the boat from its registration to the present. In this document, you can see any liens or encumbrances that the boat may have before its purchase and thus avoid surprises after its acquisition.
Change of ownership of a second-hand boat – Steps to follow
In this case, the first requirement from de Maritime Captaincy is the purchase agreement stamped by the Tax Office with the Transfer Tax paid.
To do this, the following procedure must be carried out at the Tax Office.
Documentation to be submitted to the Tax Office:

- Purchase agreement (original and copy)
- ID of the buyer and seller
- Stamped and paid Transfer Tax (three sheets)
- “Spanish Maritime Registry” certificate of the vessel (original and copy)
Once this is submitted to the Tax Office, they will immediately provide the signed and stamped purchase agreement necessary to submit to the Maritime Captaincy.
Documentation requested by the Maritime Captaincy:
- Purchase agreement stamped by the Tax Office
- “Spanish Maritime Registry” certificate of the vessel
- Application for change of ownership of the vessel
- Paid Fee 790/025
- ID of the buyer and seller
